In recent weeks, Balenciaga has released two highly controversial campaigns. The first feature was young children wearing her bag with a teddy bear styled with S&M style accessories. A lawsuit appears to have been filed in New York State Supreme Court, with Balenciaga suing North Six Inc. and its agent and set designer Nicolas de Her Jardin for $25 million in “substantial damages.” seems to be causing
In Balenciaga’s official social media statement posted on the brand’s Instagram story, they claimed that the inclusion of certain documents was done without their knowledge or approval.
Brand wrote in a story post since the deadline:We sincerely apologize for any inconvenience caused by the holiday campaign. Our stuffed bear bags should not have been featured by children in this campaign. We immediately removed the campaign from all platforms. We apologize for displaying disturbing documents in our campaign. We take this matter very seriously and are taking legal action against the parties who created this set, including unapproved items from our Spring ’23 campaign photos. We strongly condemn all forms of child abuse.We keep children safe and healthy”
Balenciaga maintains that this all happened without their knowledge, but De Jardin’s agent, Gabriela Moussaieff, said that De Jardin was “used as a scapegoat” by Balenciaga. “Everyone at Balenciaga was on set, present at every shot, and worked on editing every image in post-production,” Moussaieff continued. She also noted that the US v. Williams document was borrowed from Props.
Balenciaga has removed both campaigns from its site, but social media has yet to accept it. Some see this lawsuit as a dubious shift of blame. It completely removes Balenciaga’s role in the creative process. According to The Fashion Law, the complaint has not yet been uploaded to the New York state court database, so it’s unclear at this time what claims Balenciaga is filing.
